Only did 1 semester of law, but GBH usually requires life-threatening or life-altering injuries. I'm surprised he hasn't been charged with 'actual bodily harm', unless of course the mum's claims are bullshit.
That’s how I interpret the offence

who gives a ****...

the **** drove into oncoming traffic... he should be out of a job, not having simps on a website making excuses for him.

I think you'll find the majority of people finding some way to defend this are doing so because they're scared to their very core of him lining up in a Roosters jersey.

If any person in the community did this, you'd expect to see them locked up. There are only 2 things saving Ezra here, firstly nobody died and secondly he has ties with probably the richest sporting brand in Australia. He will be represented by the very best.

Or like if Ezra learns from this, and recompenses the victims out of his fairly it would at least be some form of restorative justice.

If you're going to get hit by someone, at least it's someone who has money.

Taking away Ezras ability to earn, kind of hurts the victims in this too.

Drugs impair your fine motor skills, regardless of ability to mask said impairment. That is the starting point of all legislation relating to being under the influence of something and driving a vehicle, horse, bicycle, whatever.

Alcohol has known effects on the body regardless of alleged “tolerance” to alcohol (usually ego related) and is eliminated from the body at a more or less consistent rate. Hence why there are various percentage levels for alcohol. 0.05%, 0.150% and so on. Medical people can describe in detail the medical effects on the body when it is affected by Acetaldehyde (metabolised byproduct of ethanol) these effects are consistent and occur independently of so-called “tolerance” so courts can be assured of the reliability of such evidence.

Illicit ‘dangerous’ drugs such as Cocaine, Methylamphetamine and so on however do not. Not as consistently or reliably as Ethanol. They also widely vary in chemical composition, strength (purity) and other factors.

This is why there is an offence for ‘driving with a relevant drug present”. Because medically speaking it is nigh on impossible to determine any reliable level of impairment for ‘low’ levels of such drugs. But such drugs ‘do’ cause impairment and so legislatures have decided to make driving under such circumstances illegal, albeit it is a very minor offence and punished far less heavily than even low ranged drink driving offences in the main.

However, when a blood sample is taken to determine quantities of such drugs in a person’s system, the toxicology results that come back in the form of an evidentiary certificate, list quantities and percentages of detected drugs present.

To determine whether the detected level of drugs in the system would result in the suspect being deemed “under the influence” the police would (or should) have sought an “expert” medical opinion from a forensic medical officer (FMO).

The drug certificate would have been provided, along with basic information on the suspect’s age, gender, height / weight, history and the observed level of indicia (how munted) the suspect was would (or should) also have been provided by the investigating police. Such might have included - manner of driving, slurred (or otherwise) speech, any conversations held (aka what was said) fixed / dilated pupils, flushed appearance, behaviour / acts at the scene, steadiness on their feet, etc.

Add all that together and you get an evidentiary basis to charge (or not) for ’under the influence’.

Thanks for taking the time to explain that Jason .

You sound high.

I’m really starting to lean towards wanting Ezra sacked. I just can’t see how he’ll be the same player again and I don’t want this club to waste 900k a season for the 3 seasons on damaged goods. Hurts me to say that. But we’ve let players dictate this clubs success for to long.

I tend to agree tbh. That won't happen though.

It’s a massive decision for the club. What impact on the playing group does this decision, either way, have? What impact on Maguire is a standard setter does it have? What impact will it have on Mam as a player moving forward? Can he come back better or will he come back worse?

I have no idea the answer to any of these but the decision makers need to get it right…he’s signed to 2029 I think. If he comes back a shell, that’s long long time to be paying him and we have a new Milford type situation on our hands. Sack him and watch him smash it at another club, we have another Gagai.

I'd prefer the NRL take the decision out of our hands TBH.

I just can't see him performing well whenever he comes back. The hate across social media is wild - I don't remember seeing as much hate as this (criticism is deserved to a degree, of course), but he's going to be booed like crazy.

Lodge would have been similar but there weren't as many performative boomers on twitter/reddit/facebook back then.

He's quite a fragile guy, we know this already.

That to me is the concern. I don't think he will be about reoffending but mentally I don't trust he is up to the task he has in front of him.

Ezra should delete any social media accounts he has and not even look at it for the whole of next season.
It would just be asking for trouble.
It's not fair but it would be in his best interests. That's the way of the world now and we all have to live in it.

Yeah I think if his social media accounts are reactivated his management team will take control of them - but there might not be much point given that he's unlikely to pick up endorsement deals going forward.

So might be best to just keep off.

Apparently there are a lot of Spencer Leniu fans out there...
