Tripp and the Storm clearly have too much money, if they can waste it on a clause that is likely unenforceable.

I fucking hope that should Donaghy/Broncos win this they hit Tripp and the Storm for costs
**** could you imagine the claim they could make in damages if Donaghy is delayed in taking up the post due to bogus court hearings
 
Part me of wonders if Storm are being so petty because there is more to this than just Donaghy.
For there sake I hope there is, because if this is just about the CEO it is fucking pathetic and sends a great message to their incoming CEO.
 
I got to. agree with you there. At the end of the day the clubs are really only competing on the field. Off the field we are thousands of km's apart and both being run competently is to a mural benefit. The real competitors for the storm wear tight shorts and collectively laugh at us the way an adult "competes" with six year old.
By the storms way if thinking, it would somehow be better if he left them for say a hypothetical afl club that say lost their CEO over say a hypothetical racism inquiry.
After all why would the afl wish harm to the one sporting franchise that could compete with them for mainstream viewing?
 
I don’t see it being enforceable when he’s working in a different city, in a different state. Commercially there’s very little overlap. Any Storm IP he may have now he would presumably still have in August. I just fail to see how the Storm can demonstrate it’s legitimately necessary to protect their commercial interests, which may be why the broncos have called them on their threat. It’s just petty & ego driven.

They would know it's not enforceable, but they're petty enough to waste 100k-200k in legal fees just to delay him working for us.

He could work in the background from home and make all the decisions . Just put PW signature on any documents

This decision will hurt them more then us in the medium to long term I'd think. If he had any friends at the storm, this may cause friction with them and they might be looking a little more often at job ads. Also, you're a valued and experienced backroom staff and 2 or 3 sporting organisations are going for you and storm are one of them. You remember they did this to an ex employee does it effect your decision? It would definetly come into my thinking....

Bitter, childish and desperate move on every level...

This is the same organisation that sat idly by while this same club had two books operating for players and they had no idea about any of it. I don’t think they know what they legally can and cannot do or enforce, the whole administration is not smart enough or competent enough to even look into it.

Fucking NSWRL is a joke of an administration.

I know they're completely inept, but why would the NRL stand on the sidelines and allow one of their top administrators be held up by a bogus non-compete clause.

And if you believe the rumours Bellmay also has a non-compete clause... so I guess the NRL would be happy to sit idly by and allow their best coach to sit on the sidelines.

They should call up the storm and tell them to cut the crap and finalise a settlement... like the Broncos have been trying to do since December... and now he's completely off contract

I am not legally minded but why have a clause in a contract that isn't legal and why did he sign it. Surely he says take that out before I sign?

Because not everyone is a legal expert, and more significantly, when you're being offered a job you're usually not in a position to negotiate so most people will take it rather than risk upsetting the person hiring you
