McGuire continued his strong run of form with another blockbusting performance but in the 10th minute was involved in an incident that maybe picked up by the MRC.

Thrashing around, McGuire appears to elbow Rory Kostjasyn violently in the face.

Does he deserve to miss time? And what will it fall under? Striking?
 
Yeah, he does.

You can't lash out with the elbow. It was unnecessary.

Grade 1 striking, and I think that would be enough for him to miss the next game with loading.

Haven't players been let off for kicking people in trying to get up. I don't think he has a case to answer. In saying that, I would expect he be charged and will likely sit out.
 
Yeah, unfortunately for Josh, it wasnt a good look. I know the Cowboys player was hanging on to slow the play the ball down but Josh attacks the head. I know its a head you would love to punch but it is bending the rules.
 
I think the precedent is that if your not looking you should get away with it. I've seen that defense used a lot.
 
Grade 1 Striking - 125 points. Early guilty plea = 95 points (rounded up). Not sure what his loading is, but would expect him to miss a week.

Having said that, like others have said, the "I was trying to get up and play the ball and didn't know he was there" defence has been used before successfully, so it might be worth trying to fight it if he's going to miss a match anyway with carry over points.
 
I am comfortable with the elbow. The guy deserved it more than once last night and I am backing McGuire even if he has to miss a game.
 
Yeah it was a bad look and I think he could miss a week. From memory though, Cam Smith was involved in a similar incident last year(?) with Matt Ballin. Was mentioned numerous times in commentary but the judiciary took no action. If he's charged, there's precedent.
 
There is no defence Josh McGuire could use I'm afraid..

Even with his one fully functioning eye, he still would have known the player was there.. He was laying on top of him..

And that elbow.. That wasn't a "I was trying to play the ball" elbow.

It was intentional.

He is screwed.

I would be extremely surprised if he plays next week. He has loading.. Which would be just enough to put him at that 100 point mark. If not over.

Smith got charged with a grade 1 striking offence. So he didn't get away with it, but was still able to play for QLD.
 
They'll hang him out to dry. It's hard to think of a worse one in recent memory TBH, and he struck him twice IIRC, so we won't be able to get away with calling it an accident while he was thrashing. Thankfully there is no escalation for Striking like there is for high tackles (careless/reckless/intentional, with the latter being 550 points just for grade 1) but I'd be surprised if they go for less than a grade 3. That's 325 points, weeks give or take depending on plea and carry-over.

I don't blame McGuire, it was early in the game but the Cows had shown that they were willing to hold on for the penalty rather than risk an unsettled defensive line. Unfortunately, even if the refs won't do anything about it, taking it in to your own hands just hurts the team down the line.
