If your cousin had wished to make a complaint and statement, the police would have seen the evidence in bruises and a broken thumb, and would have charged him.

Then it's up to the court to state if a restraining order, jail, community service etc is needed.
He got charged but it was more a less just something added to his criminial record, no jail time, no community service, just a criminial record, the police knew he did it as she told them at first but refused to make any statements or take any action against him which is what greg birds girlfriend has done which I why I think he MAY get off without jail time, i hope he gets a severe punishment, but from two personal expereinces of domestic violece where the women fails to pursue the case and the punishments have been close to nill doesn't give me much hope.

It seems you don't realise the significance of a conviction being placed on your criminal record. In domestic violence, I'd say the police prosecutor has done a pretty good job to get this result, as no doubt it was heard before a Magistrate.

Did he plead guilty or not guilty?

Also, he didn't have massive public pressure to actually do something.

Exactly. a) he wasn't a high profile public figure, b) he didn't "glass" her (major major major problem in Australia at the moment) and c) he didn't ring his mate to tell him to take the blame, didn't make his girlfriend lie etc etc.

There's two matters here I don't think NSW Justice can take lightly:
- it's a glassing, and a real opportunity to make a public statement that they just won't cop it anymore
- lying to police to try and cover it up

I doubt he'd get 4 years. But anything more than 6-12 months will just about **** his professional football career, and that should be the outcome of this.

Well criminal records aren't a good thing to have but when the person in question is from another country and went back to live their after the divorce there really wasn't much effect on him.
Anyway, I think the grub as i stated in my first posts in the thread will get 6 months to a year, I'm hoping he gets two just for the fact she could of been blind and so that disgrace of a club who made him captain get embarassed big time, captain being sent to jail not going to look good.

Unless he tries to come back to Australia. Could have some issues then.

Kevin Walters makes Greg Bird captain of Catalan
FORMER Cronulla Sharks star and NRL bad boy Greg Bird has been handed the captaincy of Super League side Catalan Dragons.
Bird who joined the Dragons, coached by former Broncos skipper Kevin Walters, after being released by the Sharks following assault charges against his girlfriend, will lead the French club against league leaders Leeds on Sunday.

Deadset, what a disgrace making a grub who glasses his girlfriend captain of the club when he's in his first few weeks their.

That was written before he was guilty wasn't it?

Geez, bad enough he's a convicted girlfriend glasser, he's also a kidnapper.

Bird is a serious doubt after damaging an abductor muscle during his side's 38-6 win over Salford 10 days ago.

I think he should get 6-12 months, which is what I think he would get, but I've seen stranger things happen. I don'tbelieve the court process brings true justice a lot of the time but we shall wait and see. I'd be VERY surprised to see him get no jail time. He might have pretty decent conditions in jail though.

My football club had a drug and alcohol talk presented by a lawyer and ex-detective Monday night.

They basically said if you hit someone at a bar, there is a chance you will get off without jail time. However, if you use a glass, you are definitley spending some time behind bars. Bird is GORNE.

Still bear in mind that's Queensland. NSW, different jurisdiction, different sentencing.

Is he going to appeal? Because I think if he does he will actually get the verdict over-turned. In fact I am surprised he was found guilty of the assault in the first place. While we all know (ie believe 100%) that he did it, as far as everything I have read/heard there is no ACTUAL evidence he did it. There were no witnesses, he has denied it and the victim is refusing to make a statement against him. The fact the 2 of them couldn't get their stories straight is the whole basis on which he has been found guilty. To my mind this is all just circumstantial evidence which I thought you couldn't convict upon. Would of thought the most he could have been convicted of was perverting the course of justice. But hey, I'm no lawyer.

I have to agree with this. After reading some of the comments made by the magistrate they would have to appeal and I think there is every prospect that it will be overturned in the higher court.

I don't think they'll be able to appeal to a higher court will they?

He hasn't stood trial, so doesn't the Magistrates court handle the appeal process aswell?

Greg Bird allowed to play for Catalans in Super League until sentencing
From correspondents in London, England
April 30, 2009
Sacked NRL star Greg Bird will be allowed to play in Europe's Super League pending a sentence for glassing his girlfriend in the face and lying to police.

The Rugby Football League (RFL) said it would take no action until ex-Test pivot Bird, who was found guilty of reckless wounding and making a false accusation to police, is sentenced in Sydney on June 22.

"We will let the criminal justice system take its course before making any enquiry of our own," the England-based RFL said in a statement.

"As is standard in all cases where a player is found guilty of a criminal act, once a final decision has been taken by the courts (including on sentence) the matter will be considered by the RFL Compliance Manager."

A precedent has been set, with England five-eighth Leon Pryce and ex-Test winger Stuart Reardon allowed to continue playing in the Super League after being convicted of assault recently.

Bird's legal counsel have indicated they will appeal against his conviction in the NSW Supreme Court.

An abductor injury may keep Bird on the sidelines, however, with his French Super League club, Catalans Dragons, saying he is in doubt for this weekend's clash with champions Leeds in Scotland.

British immigration officials refused to comment on whether Bird would be granted entry to play matches in the UK now that he has been convicted.

A UK Border Agency spokesman said: "All entry clearance decisions are taken on their individual merits in line with the immigration rules.

"Where an individual has been refused a visa they are able to apply again.

"Any new evidence and the reasons for any previous visa refusal would be considered."

The Dragons threw Bird a lifeline after he was stood down by NRL club Cronulla and then denied a working visa under tougher UK immigration laws to take up a three-year deal with Super League club Bradford.

The five-eighth was appointed Dragons captain by coach Kevin Walters after just two games off the bench, leading them to four straight wins - but they recently lost 44-10 to Hull KR in his absence.

Dragons were planning to fly Bird back to France as soon as possible following the court case to assess his injury.
