A minimum wage can be set by a governing body. It's their rules.

like all EBA's they would be able to set the minimum wage for the occupation ... but that would mean that it is the same for all players ... they wouldn't be able to have a different minimum wage for Folau and lets say J. Nik.

I don't believe any of them are very strong cases at all. Our game, our rules, don't like it, put your team in the other professional RL comp...

Under what legal basis can they not set a minimum wage of one of their assets?

To compare this to the 1991 draft is a bit of a stretch man. That entire setup, system, rort was completely doomed from the get go. It relied on dodgy tactics from the dodgiest managers and executives.
 
Whether Hayne gets it or not, the original value of his Titans contract for 2018 will come off the cap of either or both clubs.
If Parra pays $600K and the Tits pay nothing to Hayne, there will still be $600K discounted from their cap for 2018 (if the $1.2M reported figure is correct).
 
Maloney to the Panthers has been confirmed finally. What do we all think of their premiership chances next season? Despite losing Moylan & Latu, I think their team is better in 2018 with a fully healthy Mansour, Whare, Wallace, Cartwright.. And an extra year of development out of Cleary & Edwards.

TPA rules would be tough, I think the NRL would lose that fight. Players should be able to make as much money as they like off the books. But you understand why they have to enforce it.

I think the ARL restriction of trade was to do with drafting a player when Terry Hill fought it and overturned the draft.

They've got a lot of talent....but they also have Anthony Griffindor.

I actually fucked up my post. I meant to say AFL there. I thought their cap was taken to court and the AFL won.

If so, this discussion is getting bizarre. The Titans and Hayne have come to a mutual agreement, his only claim would be 1 month of the 1.2 mill, the rest is unspent money which goes back on their cap.

I just cannot see how it would be any different.

I know... it's the NRL.

If the club he goes to pays less than his 2018 contract was registered for with the NRL, the balance goes off the cap of the club which had signed that contract, regardless of how much they are actually paying the player.

I don't have one, but I remember reading this stuff about other players moving to other clubs mid contract.

Hayne is the first player that i can remember that has left a club for less and the media haven't reported that the club he was leaving have to carry the difference on their salary cap.

Probably because it doesn't fit their "he's taking a pay cut to be near his family" narrative.

If this were to be challenged you could see it being overturned

Let's just say Melbourne are paying Cam Munster 600k per year but Cam wants to come home to Brisbane to be near (insert relative name here)

Brisbane only have 150k on the cap for the next 2 years and Cam wants to play for WB

Why the hell can't he make a decision to work where where he wants, for whom he wants, at a personal financial cost?

Surely this is his right?

And whom at the NRL can say, no actually Munster is worth at least 400k, so you can't sign him for less than that?

And more importantly, how does that person make such a judgement, and how can that assessment be justified and/or quantified in court?

While I've never seen one, I'm 100% certain that the NRL would have handled it in player contracts and club licenses to make sure it's all above board. Don't like the rules, go to another company to earn your wage.

Because there is a salary cap. You can't bring real world circumstances into it and say "If I want to work for another company for less money because of various reasons", that's fine. But your profession isn't governed by a cap to try and level the playing field. By saying there should be no notional value you open up a lot of gray area and how can we be sure they wouldn't be getting payments on the side or other incentives.

In this case the whole 'needs to be closer to family' thing applies even less in this case due to the amount of clubs he could have played at and still been in Sydney.

FTR, I wasn't suggesting their shouldn't be a "notional value" as such ... just that should it ever be challenged in court there would be a strong case that would deem it illegal to be used.

and I can't see any way that the players association (or players) would agree to an EBA that included that clause in it (which i'm pretty sure would the only way to ensure there would be no successful challenge as the NRL/Clubs and players would have all agreed to those conditions.

but like the salary cap, it is one of those things that i don't see being challenged anytime soon.
