Saw it again on Fox just now... I think I saw somewhere that their argument is going to be something to do with Makasini juggling the ball and I guess that being mitigating circumstances.

He does juggle the ball, but his height doesn't change at all... absolutely no way he should be getting a downgrade.

Forceful shoulder to the head has been a grade 2 all of last year... basically every sin bin last year copped a grade 2 charge and suspension... excluding any that fell within a crackdown week

I am 100% sure they will say Walsh was a grade one from the Grand Final on Coates and was fined $3000 and then draw comparisons.

Guess the shoulder hitting the head was just AI since he was always in control. Fair play

this is the Panthers argument (should they challenge the grading) according to the SMH

Makasini juggled the ball and appeared to dip just before he was tackled by Cleary.

Cleary also showed a duty of care because both feet were planted on the ground, and he was always in control of the tackle."
He was on his toes and lost control tumbling to the ground after the contact... PVL must have given them a heads up that it'll get through because Ch 9 and Fox have demanded he play Rd 1

The other aspect at risk if Cleary gets the downgrade is precedent.

I'm not sure if the rules have changed, but teams can't point at non charged or early pleas as evidence for downgrades... however if someone goes to the judiciary and is found successful then that can be pointed at as evidence for grading.

If Cleary gets a downgrade then every forceful shoulder to the face can use it as evidence of a similar Grade 1 offence.

They'd basically be ****ing up the entire judiciary and charging process just so Cleary can play Rd 1, because that's the only reason to let him win.

Oh don't worry about precedent, that is not part of the NRL's MO.

Did he take it to the judiciary or just accept the early plea?

The previous rules were that you can only use ones that have gone to the judiciary as evidence for similar offences... otherwise you could find ones that didn't even cop a charge and point to them

Unless they have decided to change the rules... again

Also are you referring to this one where Coates is literally on his knee when he got hit?

Yeah you're right they're exactly the same 🙄🙄

I thought if it was in the last 12 months you could use it.

I thought Cleary had priors also? If he does, how can a downgrade go from 2 games to 0? This system just makes no sense to me.

Bet it comes up; it was also Walsh's third offence and still only grade one and a fine.
That's the judiciary system the NRL put in place for morons like JWH and NAS... you can get infinite grade 1 careless tackles and never serve a week on the sidelines.

What does that have to do with anything?

This is actually a better comparison tackle for the Cleary shot... Loiero on his toes (although less than Cleary), Piakura "dipping" as he braces... shoulder smokes him straight in the face.

Somehow Loiero only got a Grade 2 and 2 weeks for a tackle that probably should've been 4-6 weeks

If they are trying to downgrade, he's 100% getting off. Lol. It's what the fans want or something.
