Yeah, I can't wait till a team runs 9.5 m say from right on the 10m mark to just short of the try line drop the ball then get another crack from the scrum, I would be storming the ground if the Broncs lost a GF or Final this way.

Nope, in that case it considered that what was done was beyond anything contemplated as being within the agreed rules of playing in the NRL such that McCracken was able to pursue the matter as a civil action

As such, if a player does something that is beyond what is considered part of the inherent risks of the game, they can be privately pursued by the injured party (perhaps this may arise in the context of some of the new wrestling moves or something like that AFL player who tried to use pressure point rubbish)
 
Well yes, but I would still think the players can get some kind of professional indemnity insurance that can pay out lawsuits in the situation that they do injure someone badly while playing the game and get sued.

Just like in other professions if you inadvertently cause financial damage to your employer or their customers via a mistake in doing your job, your professional indemnity insurance can cover the costs of that.

You are right there coxy - however considering the disapproving position the Court took on the actions of the players who injured McCracken, one would have to think that the actions would fall outside the scope of any professional negligence indemnity insurance

Those indemnities have a certain scope and if your actions go outside of them, eg go from being negligent to intentional, the insurance will not cover you

I think that would all come down to intent. Bit like the grading of charges by the match review committee. A spear tackle with a few players involved can always seem to be somewhat accidental but a blatant cheap shot like an elbow to the face has intent to harm. Basically assault on the field. What would have happened if Boyd wandered into QLDs changeroom after the game and did it then. Police called, assault charges laid and the Big Marn has his day in court and sues for loss of income of his blossoming modeling career. Poor bugger now has a face for radio and appears on Lowes adds.
