I'm not sure sorry mate, I'm only really interested in arguing what is in front of me here. Perhaps neither of those players had a question mark over their head for swearing at the ref, and ending up in a position where the judicary would get involved to look at things with a fine tooth comb.
And yet they still found no proof of him swearing at the ref. There was 100% proof of Luai pushing one though, and the rule books state that they are literally a protected species. Players get suspended for touching refs, that's the blanket rule. Intentional or not, and this wasn't entirely accidental. He pushed the ref, just so happens he didn't realize it was a ref. Why is he pushing people anyway?
 
@Browny @Jason Simmons - Update to the scenario. I'm a bit of a grub in general, so you know of me, but you can still clearly see that in this moment, shit was an accident. Would you still charge me?

A mate of mine dressed in a banana suit said yelled **** you and gave the finger to his mate who was nearby police. spent the rest of his 21st in lockup.

Swears at their mate in the middle of the crowded central station at the top of their lungs. Which is of course against the law.

We wasn't charged with swearing at the ref, he was charged with Contrary Conduct. I covered this a few posts above.

I'm assuming in your example that you yelled it on purpose and not by accident. If that's wrong I admit, you're completely right and it's the same thing.

Pushing someone out of the way with your hand is not accidental though. Bumping into them might be but there's a literal act of pushing that can not be disputed. Intent to injure might lessen the case, but even so, accidents don't make things perfectly legal. And swearing in public is illegal in Australia. But we have somehow created this argument.

Easy to see which one should cop a worse punishment, even if they might not need a punishment at all. In Walsh's case, there is still 100% proof that the police officer was pushed and no proof that you swore at the police officer.

The charge states contrary conduct, sure. But three weeks for contrary conduct isn't ok either. Despite the charge name, he was only suspended for swearing at the ref in which there was zero proof. He was asked to travel to Sydney and argue his case in an unwinnable case because the NRL already had their mind made up.

You're wrong here. Luai didn't accidentally push someone. He had intent to push, it just so happened that it was someone he's not allowed to push. If he bumped into the ref accidentally, sure. But that's not what happened. He literally uses his hand to push him out of the way.

I'd like to know what would happen if I was running to a train through central station in a crowd, and I was running through those people, and one of them happened to be you. I accidentally hit you, I turn around and apologise and continue on my way.

Second scenario. I don't turn around and apologise due to the crowd and not even realising, but you can clearly see it was accidental.

How long am I in prison for?

But that isn't what happened. Using words like "in their face" is just your attempt to twist what Walsh did. Lets ask BHQ as a whole.

You're not getting bumped into. A serial grub pushes you out of the way with his hands when there's plenty of room to walk around you, not accidentally bumping into you in a crowded space.
 
That would be assault.

As you can see here, your honor, my client Jerome Luai is in a crowded space and just had to make his train. There was no space either left or right of him so he had to place his hands on the officer to push him out of the way to celebrate the arrival of his train.
