The law system... it's just the way it works isn't it? I'm not law expert but if judgement and probability were to be taken into account then things could get nasty anyway. So technically I guess he should be a free man under the justice system - which he is obviously. Sucks but it goes both ways... It would be naive to think innocent people don't go to jail which is a huge injustice so hopefully the law helps both ways.
 
I guess my problem is more in this situation it's ridiculous that because they corroborate a bullshit story the appeals judge has to accept it.

The fact is, he was convicted in the initial trial, which he faced under the presumption of innocence - which is fair enough.

IMO, and if any of our legals here can tell me if this is the case, appeals should be under the focus of "PROVE your innocence beyond reasonable doubt". I can't imagine a single human being who would have no "reasonable doubt" about this **** and bull story they made up.

And it's no surprise his lawyer (or one of them) is Chris Nyst, the fuckwit that defended the Lacey brothers, the rich sons of a businessman, who shot dead a bloke on the gold coast in 07 - and the Corby family. He just loves scum.

Yep and then she'd be found guilty of perjury. As Nashy said, it's done and dusted now. Unless he does it (or something similar) again, there is nothing she can do.
 
Not quite true. She can release a tell all book. "My horrific relationship with Greg Bird, my years of violence and the manager who blackmailed me to cooperate with them or my sex tape would be made public".... :P
 
OK, I'll clarify - nothing she can do in a legal system sense :p

They reason it went to appeal was because the defense was arguing that the trial judge (initial judge) made a decision which could not be supported by the facts, which then, if the trial judge failed to give adequate reasons for their judgement, or the appeal court thinks may be the case, the evidence can be reheard, and in this rehearing, the court of appeal, as a superior court, was able to quash the decision of the lower court. A more experienced judge heard the appeal, they are not an idiot, not some magistrate full of themselves, court of appeal judges are some of the hardest working judges, so the defense must have had a compelling argument
 
LOLZ. They got it wrong. Badly. The experienced, hard working judge, had a lovely feast of bullshit and bought it. End of story.
 
I loved the part where the appeals judge said Katie showed considerable courage for coming forward and telling the truth!

She's a role model.
 
I don't think you can be retried on the same offence once you have been cleared, so no appeal. Also the police would not waste their time trying to charge him with some other offence when the only other person in the room is saying he didn't do it.
I'm tempted to say she deserves what she gets from here on, but the poor bugger is blinded. How she can love a bloke who put a glass in her face is beyond me but domestic violence is a community wide problem and we are just witnessing a high profile case.
