take it from someone who has worked in the security industry for the past 15 years ... performing a choke hold or sleeper hold or whatever you want to call it is not a lawful method to remove someone from a premises or restrain someone.

The reason given to is the unnecessary risk of death if not performed exactly right.

We never were. What we do is called a lateral vascular neck restraint and it isn't a choke hold.

I don't need take anyone's word for anything. Any use of force to another is legal when acting in self-defence, defence of dwelling, defence of premises acting under the authority of the owner of said premises, as long as it is not excessive in the circumstances. That is what the criminal code says in plain english.

You're right, but the 'choke hold' has been deemed excessive in most situations, due the fact the that people have died from it. Which is why the police, security companies etc. now strongly discourage it's use. And it's also most likely why the Normanby aren't handing over the video.

The "chokehold" has nothing to do with them not releasing the video.
 
Yes, not illegal, but 99% of the time it will be unlawful, which is for all intents and purposes the same thing.

It will always depend on the circumstances. No use of force is 99% unlawful, where it is justified. Not even 1% and the difference between an LVNR and a 'choke hold' is a matter of positioning and is not a matter that is often tested in court.

No specific technique is 'unlawful' or 'illegal' or whichever word you choose to use. Excessive force is what is illegal and the offence depends on the circumstances. Sometimes it is assault, sometimes it is grevious bodily harm or worse.

Tremendous. I suspect that may be why he isn't arguing my point to the contrary. Or perhaps he doesn't overly care, either of which is perfectly fine.

The 'real one' though is an interesting comment. It insuates others aren't.

I suspect they are more worried about any potential loss of business due to the way the media may portray their 'aggressive' bouncers, rather than any particular concern with regards to the legality or otherwise of the actions of their employees.

If anyone had any real concern with their media only reported actions, their refusal to release footage to the NRL Integrity Unit, wouldn't be of the slightest consequence to any real investigation.

Seems little James can't stay out of trouble if the reports are true, courier mail reporting an incident at a Gold Coast nightclub on early sunday morning which he was involved.

Concerned Broncos officials have launched an investigation into claims Roberts pulled the woman’s hair so hard she was left with a sore neck. He was then reportedly thrown out of the club by bouncers.
Roberts, who recently completed a stint in a Thai rehab clinic for alcohol problems, was already on his last warning with Brisbane and his contract could be torn up if the allegations are correct.

But the player dubbed “The Jet’’ for his lightning speed says he has no knowledge of the incident at Love Nightlife at Broadbeach early on Sunday morning.
Roberts was on the Gold Coast at the weekend for the Magic Millions races.
The 23-year-old complainant, who works in a Gold Coast law firm, told The Courier-Mail she was standing in the club with friends about 1am when Roberts grabbed her from behind.
“He came up from behind me and pulled my hair quite hard and yanked my head back,” said the woman, who did not want to be named. “It was pretty forceful and quite a shock as I was just standing there and hadn’t even seen him or spoken to him.
“I had a sore neck all day yesterday. After it happened, he just walked off straight away.
“Two guys with me knew who he was and went after him … security found him and kicked him out.”

The woman, who has long blonde hair, said one bouncer comforted her while others went to find Roberts and escort him out.
“It wasn’t very nice, especially as I didn’t do anything to provoke it,” she said.
“It’s pretty strange and upsetting and something you don’t expect to happen.”
Broncos chief executive Paul White said he was unaware of the allegations but the club was investigating.
He said the club was eager to speak with the woman involved, although she was reluctant to make a formal complaint.
Roberts’ manager, Jeremy Donovan, said he had spoken to his client, who “knows nothing about it’’. The Courier-Mail tried repeatedly to contact Love Nightlife yesterday without success.
It is the latest alleged incident involving Roberts after he was thrown out of Brisbane’s Normanby Hotel last August after allegedly abusing a female staffer.
Twice sacked by former clubs Penrith and Souths, there were fears Roberts would be sacked by the Broncos, who recruited him last season following his contract forgery saga at the Gold Coast Titans.
He was spared the axe but was fined $20,000 by the Broncos and ordered to undergo counselling and take part in community service.
Roberts later checked into a Thai rehab facility to help him overcome issues including alcohol problems.
Only days ago, he spoke of his desire to have a “much better” 2017 at the Broncos.
 
Yep, last straw, piss him off.

I hate to mention it after yesterday's discussion, but if we could find a way to release him and use his funds to sign Gagai, I'd be straight on that.

Not only do I think Gagai is a more versatile player, he's clearly not half the dickhead that Roberts is, we don't need his toxicity around this playing group.

Even if he didn't assault that woman, he's at a nightclub getting hammered at 1am during the pre-season after coming back from rehab and vowing to fix his alcohol problems, he clearly hasn't. Bye bye Jimmy.
 
Come on that's the worst story I have ever read what a fucking load of shit, didn't want to make a complaint, didn't want to be named and Roberts said he wasn't even there.
 
He's denying it. How about we wait till the investigation is done before we come to any conclusions?

Ps in legal speak "reluctant to make a formal complaint" usually means "didn't happen".

innocent til proven guilty, however with this lad nothing would surprise. he has form everywhere he goes and his attitude and rockstar antics are moronic.
