if they hold it up long enough and then use his false declaration to cancel his visa. he'd miss the AO even if he challenges his cancellation in court.

besides, assuming they were doing polling, i'm pretty sure they would have it back by now. hell, they'd just have to check the online votes in the newspapers to get an idea of how the public think. just as an example, the CM's has 59425 responses (which is extremely high for one of these), with 83% voting that they believe the government should attempt to deport Novak again

Can't target the right audience through the online votes though, and they're probably only allowed subscriptions to Murdoch papers. That was a crack.

it's been reported that Novaks legal team have provided heaps of documents trying to convince the minister not to pull the trigger, so it could be that it's taking time to go through the submission.

or maybe it's simply that they're trying to avoid appearing petty by ignoring the courts ruling, and if Novak has provided them with the silver bullet, where they don't actually have to use this power, all the better for it. and if that's the case, they're probably seeking legal advice to ensure their case is bullet proof before proceeding.

Was reported earlier that the delay is due to the fact that they are getting differing legal advice from both internal and external agencies.

No idea if it's been used before. Surely Dutto threw a few out.

Todays reporting:

The Federal Government claim the delay is due to Djokovic's lawyers employing delaying tactics by saying that for a second day his legal team had dumped documents in a bid to halt the dispute.

sources close to the Djokovic camp claim that they have only submitted a single page document with one line of text.

the report also says that the the Government are determined to continue the fight, by are "extremely concerned" about losing for a second time. However, some senior figures in government have been urging the decision makers not to back down, even if that risked them suffering another, saying that the government need to continue the fight to be seen as defending the integrity of our border policy.

sources say the decision will "almost definitely" be made today

p.s. i had to laugh at that single page document with one line of text claim ... because when in the history of lawyers have they ever submitted anything so succinct ... lawyers usual policy is why use one word when 1000 will do, lol
