NRL Players and family members in hot water

Stiff shit, don’t put yourself in the position of their being enough evidence against you for the prosecution to be confident that he can win a case of rape against you.
Rape is a tough one, as i t can easily be a he said/she said situation.
A couple decide to have sex, the girl later claims rape.
You think a person should be denied his career because of accusations?

I understand your point of view, you don't need to explain it again. I don't agree with it. Being stood down for such a horrible investigation is acceptable to me, regardless of the occupation.
Its not my point of view, its due process, its how the legal system works, except in this case it seems.
Perhaps the laws should be changed.
Also im not defending Debelin, not for one second, i think if he is guilty then he should burn for it.
However you enter murky water when you start working against the system.
Whats to stop a girl from sleeping with an NRL player in the future and then just accusing him of rape, knowing full well that it will end his career, even if he is completely innocent?

There are shitty people out there, who will do anything for money/clout.
Its why we have laws and due process.

You don't need to defend your point of view. I simply don't agree with it.

Due process or not. This is no different to what happens in companies across the world, so the NRL has not done anything special.

I'm not going to discuss accusations, I'm not that interested in a discussion on it.

My opinion is that the NRL are within their rights to do it, and if he is innocent, I hope that opens him up to compensation. But that can be discussed later if needed, for now, I'm fine with what the legal system has allowed the NRL to do.

No but the NRL is caught between a rock and a hard place.

The legal process has to play out and they are erring on the side of caution.

If JDB is found guilty and he was playing the entire time then they'll be absolutely slaughtered.

If he's found not guilty then he's paid a harsh price and they'll get slammed for pre-judging an innocent man.

The harsh commercial reality is, image matters to sponsors so having a playing with a cloud like this in the comp would scare them away. The almighty dollar dictates terms here (/wally).

Again, not my point of view, its the law.
That being said, i too agree the NRL has done the right thing morally, but it should probably be written into player contracts moving forward that if you **** up big time and find yourself in a Debelin situation, that you will be stood down until it runs its course. If only to avoid a monster payout should he be found innocent.

It certainly should be in any contracts given the hassle they had with getting JDB stood down. Given it's the NRL though, they will probably won't.

He has been afforded the presumption of innocence by our legal system.

The NRL =/= the legal system.
Workplace law. If Debelin is found not guilty, he will be a millionaire courtesy of the NRL.

Is it workplace law or are you just assuming it is? As @Nashy said earlier, there's plenty of jobs where being stood down with pay is is valid action.

De Belin has been getting paid his full salary afaik, and will walk straight into a new contract the second he's found not guilty. He's got very little to sue for. He might get a couple hundred k at best.

Why should De Belin go to trial?

What have the prosecution got? Fucking nothing. They don't have any evidence that says beyond a reasonable doubt that De Belin did what was claimed. So why should he be taken to trial and risk going to jail over such a pitiful amount of evidence?

She claims rape, but her actions on the night suggest a different story. As for people wondering what she has to gain from lying.. Well, there are women out there who make up rape claims for all kinds of reasons.

There was a woman in the US that claimed she was raped after being spit roasted by two black guys because she didn't want her prospective boyfriend to think she was a slut. That was her exact reasoning.

Some women just do it out of spite. Such as a Canberra woman who is now in prison for 3 years for making a false rape claim against her former partner which resulted in him being jailed and the family going in financial ruin to pay for the legal bills.

Some women are just absolute *****.

Maybe she was raped. But they have nothing. I would very much like a justice system where you need solid evidence to back up an allegation.

Full salary doesn't equate to earning potential. If he is found innocent, he will be paid far far more than a couple hundred thousand.
Lost revenue in the prime of his career, time you cannot get back.
Its not like the corporate world, or almost any other trade in that you have a peak window earning potential, that has been taken away from him based on accusations.
If he was 100% guilty, he would be locked up as we speak, the fact he isnt means there is not enough evidence to prosecute outright.
As Fozz said, the NRL is stuck between a rock and a hard place, and they have taken the morally correct route, but it may come back to bite them hard in the hip pocket if Debelin is found innocent.
The problem with this situation is the precedence it sets. Do we just sit out players in their prime, for multiple seasons every time an accusation is made?

What the **** do you know about what they have? Let the system run it’s course and then we’ll see. I couldn’t give a **** about what some other bitch has done. There’s far more rapists than there is false accusers.

It's not that hard to find out they got nothing.

Well that’s great news. We can save millions and speed the whole justice system up by asking you to have a quick look around online and find out the truth.

???

If they had nothing, it wouldn't be going to trial. The CJS is focused more on the defendants than the aggrieved, as one of the aims is to prevent crime whether it be through deterrence or rehabilitation.

Maybe he'll get off because they can't prove it beyond a reasonable doubt which is an incredible hill to climb in a sexual assault case. That doesn't mean we should all just look the other way.

If he is guilty, he will rot in a cell, and justice will have been served.
If he is innocent, the NRL will be a few million out of pocket, and will have to backpeddle on the whole "standing players down" thing or make it a part of the player registration contract.

I doubt you have any idea what the prosecution have got, unless you are involved with the case.

all we have heard is JDB and his manager's side of the story. the police and DPP don't prosecute their cases through the media

no they won't be ... unless they are dumb ***** and settle any potential law suit.

hell JDB even dropped his case against the NRL for the stand down policy in the high courty
