Why would the Raiders even bother with court?, they will either ask for a substantial compensation amount or if they stand on a principle, just tell him to play at Souths Logan so he stays a Raider and lives up here until he is a free agent.

No breach of contract there.

Give me compensation any day of the week.
 
I don't really care what we have to do to get him, we just have to get him. He was awesome for Samoa and exactly what we need
 
How is it unconscionable if the conditions of the clause haven't been met? All the sob stories in the CM have been proven to be lies, Halo has been traveling, he has said he didn't want to move, Tony has stated his health is improving and is better than they expected it to be at this point, clause null and void.

Contract talks, 2012:

Milford, "I want to move to Canberra, but being of polynesian heritage, family is really important to me and I want to be able to be with my dad who has has a life threatening heart condition"
Raiders, "What about if we said you could walk away any time to be with your dad, no questions asked? You can leave at any time if it gets too hard"
Milford, "Great! Where do I sign?"

2014:

Milford, "My dad's really sick and wants me home. I don't want to spend the last and best days of his life 1000km away from him. He wants me to move home to spend more time with him before he dies. Don, I want out."
Raiders, "Bullshit Tony, produce a doctor's certificate because you're tricking us and your word is crap. Also the clause only applies if his condition is worsening or he is close to death (as determined by Bushman and the Raiders in their absolute discretion). Stay in Canberra or else you can sit out 2014... I'm so over players leaving this club."

Represent one thing to induce a person sign a contract, do another when time for performance comes.
 
Raiders just re-signed Mitch Cronin, possibly preparing for life without Milford.. possibly not.

Trust me...he will be able to play 5/8. Plus, Hunt is still young! and at the point where a switch back to NRL is his best option! He's too old for AFL, but perfect age to be a gun again in League. Ask yourself....would you prefer him back at the Broncos if he does come back? Or see him at another club?

I reckon you're absolutely spot on here. Wouldn't surprise me in the least coming from Don...
Wouldn't be the first player he tried to screw over!

I'm so over those Canberra ***** playing the victim card, when there's a very good chance they're probably not honoring the spirit of the clause that was inserted in the contract and allowed them to retain Milford for a couple of extra years.
 
Well essentially that's the "choice" Milford might have. Play for the Raiders, or play for nobody.

I think this will come down to the NRL's discretion.

IIRC the Gordon Tallis situation was inextricably tied to the ARL (St George) vs Super League (Broncos) war, so perhaps times have changed in that regard.

On one hand, the NRL can't be seen to undermine the integrity of the contract process by siding with the defaulting player (disregarding the merits of his walk out) but on the other they want to keep young talent in the game and keep the player's welfare at heart.

Interesting if they do knock back Milford (whose actions are essentially family orientated and in good faith) but allow the likes of Dugan, Ferguson and Carney (and to an extent Sonny Bill Williams) to **** up as much as they want, burning clubs and the NRL brand along the way and pissing on codes of conduct yet still register their contracts.

Its exactly like I said mate it's automatic it's part of the NRL rules, you can admit you're wrong occasionally mate, it's actually a good character trait.

That's a pretty below average sledge, especially ironic in a thread where I had to break the story for you.

I wonder if they'd use the Barba negotiation as a precedent?

Barba's request for a release was more culpable than here, where there is at least a "get-out" clause in the players favour (and really the argument is around its application).

On that basis a negotiated deal on the same terms as the Barba deal would be more than fair for the Raiders and the NRL.

Milford on the same money for 2014 and whatever terms the Broncos and his management can negotiate for 2015+.

Compensation... well. A virtually untested rookie versus a Dally M winner. Perhaps that's what all the Furner postulating is about: building some leverage to push his purse up.
 
I am honestly not fussed about signing him for next year straight up - Sign him for 2015 as soon as possible and the rest will sort itself out.

If he has a clause, the NRL will let one of their brightest prospects move and play football, rather than rot in reserve grade because Canberra regret losing players
